When I say that right-wingers should treat the Warren Court the way the left treats the nazis, I violently mean it. It should not only be completely discarded, but your first emotional impulse should be to the opposite of whatever the Warren Court did. It shouldn’t be precedent; it should be treated worse than garbage.
For example, normally if you try to argue (whether in an essay or in person) that we should do X policy because the National Socialist Germans did it, most liberals and normies will think you’re some kind of monster. That’s how it should be with the Warren and Burger courts. If you try to use their precedents to argue in favor of abortion, or against the death penalty, people should view you as an evil monster.
So help me, if you use Trop v. Dulles and Afroyim v. Rusk to argue against denaturalizing criminals one more time I’m going to κιΙΙ you with a trebuchet.
